Welcome to SeoulExperience (available at SeoulExperience.com and associated mobile applications, collectively referred to as the "Platform"). The Platform is owned, operated, and provided by Kori Between, Inc., a Delaware corporation in the US ("Company", "we", "us", or "our").

By accessing, browsing, registering an account, or booking any travel activity, tour, experience, or service ("Experience") listed on the Platform by independent third-party hosts or guides ("Localists"), you ("User", "Customer", or "Traveler") agree to be bound by these Marketplace Terms of Service (these "Terms").

1. Scope of Service & Platform Role

(a) Marketplace Facilitator: The Platform is an online technology marketplace connecting international travelers with local independent suppliers, tour guides, SMBs, and hosts in South Korea ("Localists").

(b) Merchant of Record (MoR): Kori Between, Inc. (Delaware, USA) is the Merchant of Record for all monetary transactions processed on the Platform. All user payments are collected directly by Kori Between, Inc. via international payment gateways (e.g., Stripe).

(c) Platform Governance vs. Operational Control: Company establishes general marketplace guidelines, listing criteria, payment processing mechanisms, and customer service policies (including cancellation and refund rules). However, Company does not supervise, direct, manage, or control the actual delivery, physical execution, or performance of the Experiences provided by Localists. Localists are independent third-party service providers, and not employees, joint venturers, partners, or agents of Company. Company is not a travel agency, transportation carrier, insurer, or tour operator.

2. User Eligibility, Accounts, & Minor Participation

(a) Account Registration: You must be at least 18 years old, or the legal age of majority in your jurisdiction if higher, to create a Platform account. At signup, you must separately confirm that you meet this age requirement. The Platform does not collect a date of birth, identity document, or guardian information solely for this confirmation.

(b) Booking Eligibility & Payment Authorization:

  1. Account Holder Bookings: Only an eligible account holder may complete a booking or financial transaction on the Platform.

  2. Payment Authorization: The account holder must be authorized to use the selected payment method and is responsible for the booking information, charges, cancellations, and compliance with these Terms.

  3. Unauthorized Transactions: If you believe a payment method or account was used without authorization, contact Company customer support promptly.

(c) Participation of Minors: A Minor may participate in an age-appropriate Experience only through a booking made and supervised as required by a responsible adult. The booking party is responsible for checking and following listing-specific age, physical, and safety restrictions.

(d) Children’s Digital Privacy: The Platform does not knowingly create accounts for children. If we learn that an ineligible child created an account, we may restrict the account and delete data not subject to a legal retention obligation.

3. Booking, Payment, and Fees

(a) Pricing & Currency: Platform prices and the authoritative booking ledger use United States Dollars (USD). A payment provider may display an estimated or charged local-currency amount. The Checkout screen shows the final amount, discounts, applicable taxes, and other required price information before payment.

(b) Payment Authorization and Confirmation: By starting payment, you authorize Company, as Merchant of Record, to charge the selected payment method for the displayed total. A booking is confirmed only after the Platform verifies successful payment and updates the booking status; a browser redirect or payment-provider screen alone does not confirm a booking.

4. Cancellation and Refund Policy

(a) Customer Standard Cancellation Terms:

  • 100% Refund: Cancellations submitted 7 days or more prior to the scheduled local start time of the Experience.

  • 50% Refund: Cancellations submitted between 48 hours and 7 days prior to the scheduled local start time.

  • No Refund (0%): Cancellations submitted less than 48 hours prior to the scheduled local start time, or in cases of customer No-Show.

(b) Localist Cancellation & Force Majeure: If a Localist cancels an Experience due to illness, severe weather, safety hazards, or force majeure, you will receive a 100% full refund or the option to reschedule. Company is not responsible or liable for secondary, ancillary, or travel-related costs (e.g., airline ticket modifications, accommodation fees, or visa fees) resulting from cancellations.

5. Prohibited Conduct, Fraud, & Account Suspension

(a) Prohibited Activities: You agree not to:

  1. Use the Platform for any illegal, fraudulent, or unauthorized purpose;

  2. Solicit, arrange, or complete direct offline bookings or payments with Localists outside the Platform;

  3. Provide false, misleading, or stolen payment details or engage in payment fraud / unlawful chargebacks;

  4. Harass, abuse, threaten, or discriminate against Localists, other travelers, or Company staff;

  5. Attempt to bypass, breach, reverse engineer, or compromise the technical infrastructure of the Platform.

(b) Suspension & Termination: Company may restrict, disable, or terminate an account or cancel a booking when reasonably necessary to address a material violation, payment fraud, legal requirement, or safety risk. Where practical, Company reviews relevant evidence before imposing a material account restriction.

6. Assumption of Risk & Health Disclaimers

(a) Voluntary Participation: Travelers acknowledge that participating in travel, tours, outdoor activities, culinary tastings, or physical activities in South Korea involves inherent risks, including physical injury, illness, property damage, delays, and unexpected local events. Travelers voluntarily assume all known and unknown risks associated with participation.

(b) Travel Insurance: Company strongly advises all international travelers to purchase comprehensive personal travel, health, accident, and cancellation insurance prior to arriving in South Korea.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Kori Between, Inc., its officers, directors, employees, agents, and local affiliates (including its affiliated local entity, Kori Between Inc. (Korea), a company in Seoul, Korea, Business Tax ID: 415-81-60456) shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the Platform or any Experience.

Without limiting the generality of the foregoing, Company explicitly disclaims liability for any loss, damage, personal injury, or death resulting from:

  1. The negligence, willful misconduct, or omissions of independent Localists or third-party service providers;

  2. Transportation delays, carrier cancellations, traffic conditions, or transit accidents;

  3. Extreme weather events, natural disasters, acts of God, epidemics, or force majeure events;

  4. Customer misconduct, failure to follow safety instructions, or pre-existing medical conditions;

  5. Third-party vendor services (e.g., restaurants, equipment rental shops, venue operators) visited during an Experience.

In no event shall Company’s total aggregate liability to you for all claims arising out of or relating to the Platform exceed the total amount paid by you for the specific booking giving rise to the claim.

8. Intellectual Property & User-Generated Content

(a) Company IP: All software, source code, UI/UX designs, trademarks, trade names ("SeoulExperience"), logos, database architectures, and original content on the Platform are the exclusive property of Kori Between, Inc. and its licensors.

(b) User Content & Reviews: By posting reviews, photos, feedback, or comments ("User Content") on the Platform, you grant Company a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to use, reproduce, display, modify, and distribute such User Content for marketing, promotional, and operational purposes across any media channel.

(c) Review Guidelines: Reviews must be honest, truthful, and based on firsthand experience. Reviews containing hate speech, profanity, commercial spam, or defamatory statements will be removed.

9. Sanctions & Export Controls Compliance

You represent and warrant that:

  1. You are not prohibited from using the Platform under applicable United States or South Korean sanctions, embargo, or export-control laws; and

  2. You are not listed on any US government list of prohibited or restricted parties, including the US Treasury Department's Specially Designated Nationals (SDN) List.

10. Governing Law & Dispute Resolution

(a) Governing Law: These Terms and any dispute, claim, or controversy arising out of or relating to the Platform or these Terms shall be governed by and construed under the internal laws of the State of Delaware, USA, without giving effect to any choice of law rules.

(b) Binding Arbitration: Any dispute arising out of or in connection with these Terms shall be settled by binding arbitration in the English language administered in accordance with applicable commercial arbitration rules, except where mandatory consumer law provides otherwise.

11. General Provisions

(a) Governing Language: These Terms were drafted in the English language. In the event of any conflict, ambiguity, or translation discrepancy between the English version and any translated version, the English language version shall control and prevail.

(b) Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

(c) Survival: Sections 1(c) (Platform Role), 5 (Prohibited Conduct), 7 (Limitation of Liability), 8 (Intellectual Property), 10 (Governing Law), and 11 (General Provisions) shall survive any termination or expiration of these Terms.

(d) Notices: Formal legal notices to Company must be sent in writing to:
